MARBLLE Website Terms
Pre-incorporation review draft — not yet effective
Effective date: Pending incorporation and final review.
About these Website Terms
These Website Terms govern use of MARBLLE’s public website at https://marblle.com (the “Website”). In these Terms, “MARBLLE”, “we”, “us” and “our” refer to the Website operator identified below. References to the Website do not mean our managed automation services or a client portal.
Website operator: Pending incorporation. The intended entity is MARBLLE, LLC, planned for formation in Delaware, United States; it has not yet been formed.
Postal address: Pending incorporation; confirm before publication.
Contact: contact@marblle.com
[Before publication: confirm the operator, effective date and how these Terms will be presented to Website users. This draft is not an agreement currently in effect.]
Separate client agreements
MARBLLE provides bespoke business automation services under individually agreed client contracts.
Any services, pricing, payment terms, guarantees, cancellations, refunds, and other contractual obligations are governed by the separate agreement entered into between MARBLLE and the client.
These Website Terms govern the use of our website and do not replace or modify any separately executed client agreement.
In particular, the Website disclaimers, liability provisions and access restrictions below apply only to Website use. They do not override a guarantee or other obligation in a separately executed client agreement. If these Website Terms conflict with a separately executed client agreement concerning client services, that client agreement governs those services.
Using the Website
The Website is intended to provide information about our business services and enable business enquiries and consultation bookings. It does not currently provide public account registration or direct payment collection.
You may use the Website for its intended lawful purposes. You must not:
- violate applicable law or infringe another person’s rights;
- introduce malware or attempt unauthorised access to the Website or its systems;
- disrupt, overload or interfere with the Website’s operation;
- use the Website to impersonate others, misrepresent your authority or send unlawful or abusive communications; or
- reproduce or commercially exploit Website content without permission, except as permitted by applicable law or an applicable licence.
Contacting us or booking a consultation does not, by itself, execute a client service agreement.
Intellectual property
Website content and design are protected by applicable intellectual property laws. Rights belong to MARBLLE or the relevant owners and licensors. You may view and use the Website for its intended purpose; no ownership rights are transferred to you.
Third-party names, trademarks and logos remain the property of their respective owners. Their display does not by itself imply an endorsement or partnership.
If you believe Website content infringes your rights, contact contact@marblle.com with details of the work, the material concerned, its location and your contact information.
Third-party websites and services
The Website includes links to third-party websites and services, such as consultation scheduling. Their terms and privacy practices apply when you use them. We do not control their content, availability or practices.
Privacy
Our Privacy Policy describes how personal information is handled. It is currently a pre-incorporation draft and must be finalised before publication. These Website Terms do not replace the Privacy Policy or any data-processing provisions in a client agreement.
Availability and Website disclaimers
To the extent permitted by applicable law, the Website is provided “as is” and “as available”, without warranties concerning the Website’s availability, accuracy, fitness for a particular purpose or freedom from errors. We do not guarantee uninterrupted or error-free Website access.
These disclaimers concern the Website only. They do not disclaim obligations concerning client services under a separately executed agreement or exclude rights that cannot lawfully be excluded.
Website liability
To the extent permitted by applicable law, MARBLLE will not be liable for indirect, incidental, special or consequential losses arising from use of, or inability to use, the Website.
[Any aggregate monetary liability cap for Website use: pending legal review. No amount or service-fee-based cap has been approved.]
Nothing in these Website Terms excludes or limits liability or statutory rights where doing so is prohibited by applicable law. Liability for managed automation services is governed by the applicable client agreement.
Restricting Website access
We may restrict access to the Website where necessary to address misuse, security concerns or legal requirements. We may also change or discontinue the Website. This concerns Website access only and does not, by itself, suspend or terminate a client service agreement or change obligations under it.
Governing law and disputes
Governing law and courts for Website-use disputes: Pending legal review and confirmation before publication. The planned place of incorporation is not a confirmed choice of governing law or forum.
Separate client agreements may specify the law and dispute arrangements applicable to those agreements. Mandatory rights under applicable law are not excluded.
Changes and general provisions
We may update these Website Terms. The final published version will identify its effective date, and we will provide notice of material changes where required by applicable law. Changes to these Website Terms do not amend a separately executed client agreement.
These Website Terms concern Website use only. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Failure to enforce a provision does not waive the right to enforce it later.
Questions about these Website Terms may be sent to contact@marblle.com.
